Sandra Lundy Published in Boston Bar Journal
Sandra E. Lundy, a member of Tarlow Breed Hart & Rodger’s Family Law Practice Group, recently published an article in the Boston Bar Journal, a peer reviewed publication of the Boston Bar Association. Entitled, “Magazu and the Expansion of Agency Power,” Sandy’s article argued that the recent Supreme Judicial Court case of Magazu v. Department of Children and Families has troubling implications for the expansion of agency power. 

The case pitted the state’s obligation to protect foster children from corporal punishment against a family’s religious beliefs. While the SJC found in favor of the Department of Children and Families, thus prohibiting the Magazus from becoming foster parents, Sandy argues that the Court’s interpretation of the extent of a state agency’s power was based on “unwritten rules,” and opens the door to bureaucratic over-reach.
